Abstract

The article discusses the legitimacy of mandatory vaccination against COVID-19 from the perspective of international human rights law. The paper analyzes the concept of mandatory vaccination, the consequences of non-compliance, as well as the current state practice and tendencies of national policies. The article focuses on the principles defined by the World Health Organization (WHO) in the case of mandatory vaccination for COVID-19, which closely adheres to the legal elements of necessity and proportionality. The article also analyzes the practice of the European Court of Human Rights and the Supreme Court of the United States of America, the Universal Declaration on Bioethics, and Human Rights and the Oviedo Convention on Human Rights and Biomedicine. In addition, the current legal framework of Georgia is discussed along with the specific criteria that must be followed and considered by the decision-making authorities on these matters.
