ქალთა მიმართ ჩადენილი სექსუალური ხასიათის დანაშაულები საერთაშორისო კონფლიქტის დროს

Abstract

Throughout history, wars have been accompanied by exceptional cruelty, which from a modern legal perspective should be considered a mass violation of human rights. Although armed conflicts affect all members of society, regardless of gender, race, color, sex, origin, ethnicity, language, or religion, women were and are particularly vulnerable during the war.
Violations of women's rights during conflict are still an urgent problem. This was once again demonstrated by the recent events in Ukraine, from which it is clear that the brutality of war particularly affects girls and women.
Based on the comparative method, the paper describes the assessment of sexual crimes committed against women in the light of international humanitarian law, international criminal law, and international human rights law. In addition, it analyzes the legal
challenges that arise during the examination of these crimes and offers some recommendations for the future.
The paper, among other sources, is based on the relevant practice of the International Court of Human Rights and the International Criminal Court, as well as the opinions, criticism, and comments of scholars.
