The presumption of innocence is the most important legal guarantee for a defendant. This principle is often violated
by the media, due to the journalists’ interest in providing the public with impressive information about the
defendant, which is frequently detached from objective reality. Therefore, it leads to the formation of false social
opinions regarding the guilt of the accused and his/her stigmatization in society. The aforementioned problem
requires an adequate solution – the establishment of such law wherein the freedom of expression of the media and
the presumption of innocence of the defendant is fully protected.
